IMC Council
The Council of the IMC, composed of seven (7) members of whom five (5) are resident members of Kosovo whilst two (2) are international members, is the decision making body. Four resident members are nominated by Civil Society and one is nominated by the Kosovo Assembly. All of them are appointed by the Kosovo Assembly. The two international members are appointed by the Special Representative of the Secretary General. The Council directs the Commission with respect to strategic matters that concern the application of the IMC law. The Council issues acts, instructions, policies and duties that are necessary for the effective functioning of the Council. Based on the advice and recommendations of the Office of the Executive Chief, the Council issues licenses and their renewal, granting to the authorized entities the right of frequency usage in the Broadcast Frequency Spectrum, as well as has the power to pronounce sanctions for violation of commission regulations or violation of license provisions. From August 2007 to March 2008 the Council of the Independent Media Commission was not complete. Explanation: According to the IMC Law, Article 4.4 b “The Executive Chief of the IMC shall initiate the nomination procedure for the Civil Society Council members, by issuing a public invitation not later than 3 (three) months before the expiration of the term of office of the Civil Society Council Member” Based on this, the Executive Chief has initiated the procedure of nomination for the vacant positions of the two local IMC members on 10 April 2007, a procedure that ended on 9 May 2007. On 14 June 2007 the IMC has submitted to the Assembly the short-listed names of nominees.
On 17 September 2007 the Kosovo Assembly has established the ad-hoc commission. On march 14, 2008 the two new members of Concil were appointed by the Assembly of Kosova. Composition of the IMC Council in a period from 28 August 2006 to 28 August 2007 Explanation:
According to Article 5 of the IMC Law: “Duration of Council Appointments” “Terms of appointment for international Council members shall be as follows: a. The initial term of appointment for one international member shall be eighteen (18) months; b. The initial term of appointment for another international member shall be twelve (12) months;” “The terms of five (5) resident members shall be as follows; a. All resident members of the Council shall be appointed for a term of two (2) years; b. As an exception to Article 4.2 (a) of this Law, the initial term of two (2) Civil Society Council members shall be one (1) year for each of them, and shall be elected through a lottery drawn by the Temporary Media Commissioner in a Public” The international member of the IMC Council Katrin Nyman Metcalf had 12 months mandate. Her mandate ended on 28 august 2007. Isuf Berisha and Ilir Dugolli, local members nominated from the civil society, had mandates of one year. Their mandate ended on 28 august 2007. |
